Terms of Trade

By purchasing from us, you engage in our “Service” and agree to be bound by the following terms and conditions.
You can review the most current version of the Terms of Trade at any time on this page. We reserve the right to update, change or replace any part of these Terms of Trade by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
1) Delivery Our bulbs are only available for delivery within NZ. We are a family run business located in Canterbury, NZ. Our delivery times vary depending on how busy we are: please allow up to 10 working days for us to process and package your order. We deliver our bulbs through NZPost Couriers. Once the bulbs are dispatched delivery is usually overnight but please allow up to 3 working days. We can deliver to anywhere in NZ. If you have not received your order within 14 working days, you need to notify us. For us to be able to claim for loss parcels we must be notified within 20 working days of when the order was placed.
2) Cancellations, returns and/or refunds To cancel your order please let us know within 24 hours, we cannot cancel your order once the bulbs are dispatched. Please open your bags of bulbs upon arrival and check your order is all there and delivered safely. Any concerns please let us know within 5 working days to allow us to remedy them for you. To be eligible for a return or exchange, the product must be in its original packaging and in the same condition as when it was received. We may ask you to provide photographs of the damaged or defective product, or to return the product to us for inspection. If a return is approved, we will provide you with instructions for returning the product to us.
3) Bulbs change hands upon successful delivery Our Bulb prices listed on our website include GST and are listed in NZD. The delivery cost specified includes all packaging. Delivery organised by us is done on behalf of the purchaser. Bulbs travel at our risk but upon confirmed delivery by NZPost becomes the purchaser’s risk and are uninsured. All pricing and other information supplied by us is only valid for the sales season for which it was given.
4) Our payment terms Advance payment is required for all orders placed through our website.
5) What we guarantee We guarantee our own bulb stocks to be healthy and flowering size. We do not accept liability for any changes in bulb quality or poor flower formation after the bulbs are delivered or collected. This is because, the storage environment and its duration prior to planting, and the growing environment, are all beyond our control after they leave are delivered or collected. It is the purchaser’s responsibility to ensure that the bulb quality is checked on arrival by a bulb knowledgeable person and any claim notified within 10 days. To put in a later claim for that which could not be determined in that ‘arrival check’, you must notify us no later than the 2nd day of flowering. We must have access to the plants and an ongoing sequence of flower development photos must be taken.
6) Disputes procedure In the event of a dispute you agree to enter into mediation with an independent Flower Bulb Industry specialist (the most appropriate person might not be a NZer) and to be bound by his/her determination. The same conditions apply to us.
7) Supplying problems Accepting your order does not mean that we guarantee supply. We retain the right to cancel an order to protect our bulb planting stock levels. Until the bulbs are counted out, all quantities shown on confirmed orders are estimates only. You will get priority on other lines if this happens.
8) Liability limits The purchaser accepts that Hadstock Farm shall not be liable for any loss of in- come (including flower income) to the purchaser, or liability to third parties by the purchaser, that may result for whatever reason, from the bulbs it has supplied to the purchaser, or from its inability to supply for the reasons listed above. The maximum liability of Hadstock Farm in regard to any claim against its products is limited to replacement of the goods supplied during the following bulb sales season. If this is not possible then payment shall be based on the original invoice values (not the purchaser’s landed values). We accept no responsibility for the outcome of following any advice we give on flower production. Our expertise is bulb production not flower production.
9) You agree By placing an order you indicate your acceptance of all the above conditions.
